  1. AGREEMENT TO RECEIVE TEXT MESSAGES

These SMS Terms of Service (“SMS Terms”) govern participation in text messaging programs offered by Super Save, Inc., doing business as:

  • Super Save Fuel
  • Super Save Car Wash
  • Super Save Mart

(collectively, “Super Save,” “Company,” “we,” “our,” or “us”).

By providing your mobile telephone number and opting into any Company messaging program, you agree to receive text messages in accordance with these SMS Terms.

You are solely responsible for any fees charged by your wireless provider.

  1. ELIGIBLE DEVICES AND CARRIERS

Not all mobile devices or wireless carriers support all messaging programs.

Delivery may be limited by:

  • Device compatibility
  • Carrier restrictions
  • Network availability
  • Geographic limitations

Super Save does not guarantee message delivery.

  1. OPTING OUT

You may opt out of SMS communications at any time.

  1. EFFECT OF OPTING OUT

Upon successful opt-out:

Super Save shall not be responsible for:

  • Undelivered messages
  • Delayed messages
  • Messages sent to outdated numbers provided by customers
  1. CHANGES TO MOBILE NUMBERS

If you change or deactivate a mobile number:

You agree to promptly update your account information.

Failure to update account information may result in messages being delivered to another person assigned the recycled number.

  1. CONSENT RECORDS

Super Save may maintain records of:

  • SMS opt-ins
  • SMS opt-outs
  • Enrollment dates
  • Consent acknowledgements
  • Message history
  • Membership activity

These records may be retained for compliance, operational, legal, and dispute resolution purposes.

  1. THIRD-PARTY SERVICE PROVIDERS

SMS services may be provided through third-party vendors.

Providers may assist with:

  • Compliance monitoring

Super Save may use third-party platforms to facilitate communications.

  1. NO GUARANTEE OF DELIVERY

Message delivery depends upon:

Super Save shall not be responsible for delayed, blocked, or undelivered messages.

  1. CARRIER DISCLAIMER

Wireless carriers are not liable for delayed or undelivered messages.

Carriers do not sponsor, endorse, administer, or assume responsibility for Company messaging programs.

  1. PRIVACY

Information collected in connection with SMS programs is governed by the Company’s Privacy Policy.

Customers should review the Privacy Policy for information regarding:

  • Data collection
  • Data usage
  • Data sharing
  • Customer rights
  1. TERMINATION OF PROGRAMS

Super Save reserves the right to:

  • Modify SMS programs
  • Suspend SMS programs
  • Terminate SMS programs

At any time and without prior notice where permitted by law.

  1. DISCLAIMER OF WARRANTIES

SMS services are provided:

“AS IS”
and
“AS AVAILABLE”

Super Save makes no guarantees regarding:

  • Message delivery
  • Delivery timing
  • Availability
  • Error-free operation
  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Super Save shall not be liable for:

  • Delayed messages
  • Failed message delivery
  • Carrier failures
  • Network interruptions
  • Indirect damages
  • Consequential damages
  1. GOVERNING LAW

These SMS Terms shall be governed by the laws of the State of Illinois.

  1. ARBITRATION

Any dispute relating to SMS programs shall be resolved through binding arbitration in accordance with the Company’s Terms & Conditions.

  1. CLASS ACTION WAIVER

To the maximum extent permitted by law:

Customers waive any right to participate in:

  • Class actions
  • Collective actions
  • Representative actions
  • Mass actions

relating to SMS communications.
