SUPER SAVE FUEL & RETAIL SERVICES TERMS

These Fuel & Retail Services Terms (“Fuel & Retail Terms”) govern the purchase and use of products and services offered by Super Save, Inc. through its fuel stations, convenience stores, loyalty programs, rewards programs, websites, mobile applications, and related services.

By purchasing fuel, merchandise, services, rewards, or participating in any related program, you agree to these Fuel & Retail Terms.

These Terms apply to:

• Diesel sales
• Fuel rewards programs
• Fuel discounts
• Fleet-related programs
• Promotional fuel offers

Retail Services

• Convenience store purchases
• Food and beverage sales
• Tobacco sales where permitted by law
• Lottery sales where permitted by law
• General merchandise sales
• Promotional merchandise programs

Customer Programs

• Loyalty programs
• Rewards programs
• Mobile application programs
• Promotional programs
• Digital coupon programs

3. PRODUCT AVAILABILITY

Super Save does not guarantee:

• Product availability
• Inventory availability

• Promotional availability
• Continuous service availability

4. PRICING

Prices may vary by:

Displayed prices are subject to correction in the event of:

• System errors
• Pricing errors
• Technical errors
• Human errors

Super Save reserves the right to correct pricing errors before or after a transaction where permitted by law.

5. FUEL SALES

Fuel purchases are subject to:

• Government regulation
• Equipment availability
• Payment authorization requirements

Fuel prices may change without notice.

Super Save does not guarantee that fuel prices will remain unchanged for any period of time.

6. PAYMENT AUTHORIZATION

By initiating a transaction, you authorize Super Save and its payment processors to:

• Verify payment methods
• Obtain authorizations
• Process payments
• Reverse transactions where necessary
• Correct transaction errors

Payment processing may be performed by third-party providers.

7. PREAUTHORIZATION HOLDS

Certain fuel purchases may result in temporary preauthorization holds being placed by payment processors or financial institutions.

Such holds are controlled by:

• Banks
• Card issuers
• Payment processors

and not by Super Save.

The timing of release of such holds is determined by the customer’s financial institution.

8. LOYALTY PROGRAMS

Participation in loyalty programs is voluntary.

Super Save reserves the right to:

• Modify loyalty programs
• Suspend loyalty programs
• Terminate loyalty programs
• Change eligibility requirements
• Change earning methods
• Change redemption methods

at any time.

9. REWARDS PROGRAMS

Rewards may be earned through:

• Fuel purchases
• Retail purchases
• Promotional activities
• Membership participation
• Other qualifying activities

Rewards:

• May expire;
• May be modified;
• May be cancelled;
• Have no cash value unless expressly stated otherwise.

10. PROMOTIONS

Super Save may offer promotions including:

• Fuel discounts
• Car wash discounts
• Retail discounts
• Loyalty promotions
• Rewards promotions
• Digital promotions

Promotions:

• May be modified;
• May be terminated;
• May be limited;
• May contain additional restrictions.

Promotional offers are subject to availability and applicable terms.

11. DIGITAL COUPONS AND OFFERS

Digital offers may be provided through:

• Websites
• Mobile applications
• Loyalty programs
• Rewards programs
• SMS programs
• Email programs

Digital offers may:

• Expire without notice;
• Be limited in quantity;
• Be limited by location;
• Be subject to eligibility requirements.

12. RECEIPTS

Customers may receive receipts through:

• SMS receipts
• Mobile applications

Customers are responsible for reviewing receipts and reporting transaction concerns promptly.

13. CUSTOMER RESPONSIBILITIES

Customers agree to:

• Provide accurate information;
• Use payment methods lawfully;
• Follow posted instructions;
• Comply with applicable laws;
• Maintain accurate account information.

Customers remain responsible for all transactions conducted using their payment methods unless prohibited by law.

14. REFUNDS AND RETURNS

• Promotional restrictions

Certain items may be non-returnable, including where prohibited by law.

Proof of purchase may be required.

17. FRAUD PREVENTION

where fraud, abuse, misuse, or unlawful activity is suspected.

18. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

SUPER SAVE DISCLAIMS ALL WARRANTIES INCLUDING:

• MERCHANTABILITY;
• FITNESS FOR A PARTICULAR PURPOSE;
• NON-INFRINGEMENT;
• CONTINUOUS AVAILABILITY.

19. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPER SAVE SHALL NOT BE LIABLE FOR:

• INDIRECT DAMAGES;
• INCIDENTAL DAMAGES;
• CONSEQUENTIAL DAMAGES;
• SPECIAL DAMAGES;
• PUNITIVE DAMAGES;
• LOST PROFITS;
• LOST REVENUE;
• BUSINESS INTERRUPTION.

TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE APPLICABLE TRANSACTION GIVING RISE TO THE CLAIM.

20. INDEMNIFICATION

Customers agree to defend, indemnify, and hold harmless Super Save from claims arising from:

• Misuse of services;
• Fraudulent conduct;
• Violation of law;
• Violation of these Terms.

21. ARBITRATION AND CLASS ACTION WAIVER

All disputes relating to fuel purchases, retail purchases, loyalty programs, rewards programs, promotions, or related services shall be governed by the arbitration and class action waiver provisions contained in the Super Save Terms & Conditions.

22. GOVERNING LAW

These Fuel & Retail Terms shall be governed by the laws of the State of Illinois.

23. MODIFICATIONS

Super Save reserves the right to modify these Fuel & Retail Terms at any time.

Updated versions become effective upon posting unless otherwise stated.

Continued use of products or services constitutes acceptance of revised Terms.
