SUPER SAVE MEMBERSHIP TERMS

These Membership Terms (“Membership Terms”) govern participation in all Super Save membership programs.

These Membership Terms are incorporated into and made part of the:

• Terms & Conditions
• Privacy Policy
• Automatic Renewal Terms
• Cancellation Policy
• SMS Terms & Conditions

By purchasing, enrolling in, activating, using, renewing, or participating in a membership program, you agree to these Membership Terms.

1. COMPANY INFORMATION

These Membership Terms apply to:

2. MEMBERSHIP PROGRAMS COVERED

These Membership Terms apply to memberships purchased through:

• Pay stations
• Mobile applications
• Washify
• ICS
• DRB
• Company websites
• In-store enrollment
• Customer service enrollment
• Promotional enrollment
• Future enrollment platforms

Membership offerings may vary by location.

Not all locations offer the same programs.

3. TYPES OF MEMBERSHIPS

Super Save may offer one or more of the following:

A. Prepaid Memberships

A prepaid membership:

• Is purchased for a defined period;
• Expires at the end of the purchased term;
• Does not automatically renew unless separately enrolled into a recurring program;
• Is subject to these Membership Terms.

Examples include:

• One-month prepaid memberships
• Promotional prepaid memberships
• Limited-duration memberships

B. Recurring Memberships

A recurring membership:

• Continues until cancelled;
• May be billed monthly or at another disclosed interval;
• Is governed by the Automatic Renewal Terms;
• Requires customer authorization.

Recurring memberships remain active until cancelled in accordance with applicable policies.

4. MEMBERSHIP ENROLLMENT

Memberships may be purchased:

• At a pay station;
• Through a mobile application;
• Through Washify;
• Through ICS;
• Through authorized websites;
• Through customer service representatives;
• Through in-store enrollment.

Customers may be required to provide:

• Name;
• Phone number;
• Email address;
• Vehicle information;
• License plate information;
• Payment information;
• Other information reasonably necessary to administer the program.

5. CUSTOMER ACKNOWLEDGMENTS

By enrolling in a membership, you acknowledge and agree that:

• You are authorized to use the payment method provided;
• Information provided is accurate;
• Vehicle information is accurate;
• You have reviewed applicable terms and policies;
• You will comply with membership requirements.

Electronic signatures, electronic acknowledgments, app confirmations, pay station confirmations, digital checkboxes, and similar methods shall be deemed legally binding.

6. VEHICLE REGISTRATION

Memberships are generally assigned to a specific vehicle.

Vehicle identification may occur through:

• License plate recognition;
• Vehicle registration information;
• RFID technology;
• Barcode systems;
• Membership databases;
• Other identification methods.

Super Save reserves the right to determine eligibility and identification methods.

7. LICENSE PLATE RECOGNITION

Certain locations utilize License Plate Recognition (“LPR”) technology.

Customers participating in membership programs may have vehicle information associated with:

• Membership accounts;
• Visit history;
• Usage records;
• Account administration.

Not all locations utilize LPR technology.

8. VEHICLE LIMITATIONS

Unless expressly authorized by Super Save:

• One membership is limited to one vehicle.
• Memberships may not be shared.
• Memberships may not be transferred.
• Memberships may not be used for commercial fleet purposes.
• Memberships may not be used by unauthorized vehicles.

Violation of this section may result in suspension or termination.

9. USAGE LIMITATIONS

Membership benefits are intended for normal consumer use.

Super Save reserves the right to establish reasonable usage limitations.

Examples may include:

• One wash per day;
• Time restrictions;
• Vehicle restrictions;
• Program restrictions;
• Promotional limitations.

Excessive or abusive usage may result in suspension or termination.

10. ACCOUNT MAINTENANCE

Customers are responsible for:

• Maintaining accurate contact information;
• Maintaining accurate vehicle information;
• Updating payment information;
• Reporting unauthorized use.

Super Save is not responsible for losses resulting from inaccurate customer information.

11. PREPAID MEMBERSHIPS

Prepaid memberships:

• Expire at the conclusion of the purchased term;
• Are not automatically renewed unless separately authorized;
• May be subject to additional promotional conditions.

Expiration occurs regardless of usage.

Unused benefits generally have no cash value and are not refundable unless required by law.

12. RECURRING MEMBERSHIPS

Recurring memberships are governed by:

• Membership Terms;
• Automatic Renewal Terms;
• Cancellation Policy.

Customers enrolling in recurring memberships authorize recurring charges as disclosed during enrollment.

13. PAYMENT AUTHORIZATION

By providing a payment method, customers authorize Super Save and its service providers to process authorized charges.

Payment processing may occur through:

• Washify;
• ICS;
• DRB;
• Payment processors;
• Future authorized vendors.

Customers remain responsible for amounts owed.

14. FAILED PAYMENTS

If payment authorization fails:

• Membership access may be suspended;
• Membership benefits may be limited;
• Collection efforts may occur;
• Membership may be terminated.

Super Save may attempt to reprocess authorized payments where permitted by law.

15. MEMBERSHIP CHANGES

Super Save reserves the right to:

• Change membership pricing;
• Change membership features;
• Modify program benefits;
• Modify enrollment procedures;
• Modify vehicle eligibility;
• Modify operating rules.

Changes shall be effective as disclosed by Super Save.

16. CUSTOMER CANCELLATIONS

Cancellation procedures are governed by the Cancellation Policy.

Customers may cancel through authorized methods including:

• Mobile applications;
• Customer service;
• Telephone;
• In-person requests;
• Other approved methods.

Cancellation effectiveness may vary based on the membership type.

17. SUSPENSION AND TERMINATION

Super Save reserves the right to suspend or terminate memberships for:

• Fraud;
• Misrepresentation;
• Unauthorized use;
• Chargebacks;
• Abuse of benefits;
• Violation of policies;
• Illegal activity;
• Threatening conduct;
• Safety concerns.

Suspension or termination may occur without prior notice where permitted by law.

18. NO PROPERTY RIGHTS

Memberships:

• Are licenses;
• Are revocable;
• Have no ownership value;
• Have no transferable value;
• Do not constitute property rights.

Membership participation remains subject to these Terms.

19. DISCLAIMERS

Membership programs are provided subject to:

• Equipment availability;
• Operational limitations;
• Weather conditions;
• Maintenance requirements;
• Vendor availability;
• Technology limitations.

Super Save makes no guarantee regarding uninterrupted availability.

20. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPER SAVE SHALL NOT BE LIABLE FOR:

• INCIDENTAL DAMAGES;
• INDIRECT DAMAGES;
• SPECIAL DAMAGES;
• CONSEQUENTIAL DAMAGES;
• LOST PROFITS;
• LOST REVENUE;
• LOSS OF USE.

TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE APPLICABLE MEMBERSHIP DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

21. ARBITRATION AND CLASS ACTION WAIVER

Membership disputes are subject to:

• Mandatory Arbitration;
• Class Action Waiver;

as described in the Super Save Terms & Conditions.

22. GOVERNING LAW

These Membership Terms shall be governed by Illinois law.

23. MODIFICATIONS

Super Save reserves the right to modify these Membership Terms at any time.

Updated Membership Terms become effective upon posting unless otherwise stated.

Continued participation constitutes acceptance of revised terms.
