These SMS Terms & Conditions (“SMS Terms”) govern participation in SMS, text messaging, mobile messaging, alerts, notifications, promotions, and related communication programs offered by Super Save, Inc.

These SMS Terms are incorporated into and made part of the:

  • Privacy Policy
  • Terms & Conditions
  • Membership Terms
  • Automatic Renewal Terms
  • Cancellation Policy

By enrolling in, subscribing to, participating in, or receiving SMS communications from Super Save, you agree to these SMS Terms.

2. TYPES OF SMS COMMUNICATIONS

Super Save may provide various types of SMS communications including:

Transactional Messages

Examples include:

  • Receipt delivery
  • Purchase confirmations
  • Membership confirmations
  • Membership updates
  • Renewal notices
  • Cancellation confirmations
  • Account notifications
  • Service alerts
  • Customer service communications
  • Security notifications

Promotional Messages

Examples include:

  • Discounts
  • Promotions
  • Special offers
  • Loyalty program offers
  • Fuel promotions
  • Car wash promotions
  • Retail promotions
  • Rewards program communications
  • Marketing campaigns

Participation in promotional messaging programs is voluntary.

3. SEPARATE MARKETING CONSENT

Customers are not automatically enrolled in promotional SMS programs merely because they:

  • Purchase fuel;
  • Purchase a car wash;
  • Purchase retail merchandise;
  • Join a membership;
  • Request a receipt;
  • Create an account;
  • Verify a phone number;
  • Provide contact information.

Promotional SMS enrollment generally requires a separate enrollment process and separate consent.

Consent to receive promotional SMS messages is not a condition of purchasing any goods or services.

4. ENROLLMENT METHODS

Enrollment in promotional SMS programs may occur through:

  • Washify mobile applications
  • ICS mobile applications
  • OptSpot marketing programs
  • Super Save websites
  • Loyalty programs
  • Rewards programs
  • Membership programs
  • Promotional campaigns
  • Other authorized enrollment methods

Enrollment requirements may vary depending upon the platform being used.

5. THIRD-PARTY MESSAGING PROVIDERS

Super Save may utilize third-party service providers to administer SMS programs.

Such providers may include:

  • Washify
  • ICS
  • DRB
  • OptSpot
  • Marketing vendors
  • Loyalty providers
  • Customer engagement platforms
  • Future service providers

Customers participating in SMS programs may also be subject to the applicable terms, privacy policies, and consent procedures of those providers.

6. WASHIFY AND ICS PROGRAMS

Certain promotional messaging programs may be administered through:

  • Washify
  • ICS

Where such platforms require separate consent, customers must complete the applicable enrollment process before receiving promotional SMS communications.

Enrollment procedures may include:

  • Phone number submission
  • Verification processes
  • Electronic consent
  • Acceptance of platform terms
  • Acceptance of privacy policies

7. OPTSPOT PROGRAMS

Super Save may utilize OptSpot or similar providers for certain promotional messaging programs.

Where applicable:

  • Customers voluntarily enroll;
  • Customers provide required consent;
  • Customers may opt out at any time;
  • Customers are not required to participate as a condition of purchase.

8. MESSAGE FREQUENCY

Message frequency may vary.

The number of messages sent may depend upon:

  • Membership participation
  • Loyalty participation
  • Promotional participation
  • Customer preferences
  • Service activity

Super Save does not guarantee any specific message frequency.

9. MESSAGE AND DATA RATES

Message and data rates may apply.

Customers are responsible for:

  • Wireless charges
  • Carrier fees
  • Data charges
  • Text messaging charges

imposed by their wireless provider.

10. STOP INSTRUCTIONS

Customers may opt out of promotional SMS communications at any time.

To stop receiving promotional messages:

Customers may also use any other opt-out methods made available through the applicable messaging platform.

12. CUSTOMER RESPONSIBILITIES

Customers are responsible for:

  • Providing accurate phone numbers;
  • Updating phone numbers when changed;
  • Maintaining account information;
  • Reviewing applicable program terms.

Customers represent that they are authorized to enroll the mobile number provided.

13. REASSIGNED NUMBERS

Customers must promptly notify Super Save if they:

  • Change mobile numbers;
  • Transfer mobile numbers;
  • Lose access to mobile numbers.

Super Save shall not be responsible for communications sent to numbers that customers fail to update.

14. CARRIER DISCLAIMER

Wireless carriers are not liable for delayed or undelivered messages.

Message delivery depends upon:

  • Carrier systems
  • Network availability
  • Device compatibility
  • Third-party systems

Super Save does not guarantee message delivery.

15. AVAILABILITY

SMS programs may be:

  • Modified;
  • Suspended;
  • Limited;
  • Discontinued;

at any time without prior notice.

Participation in any SMS program is a privilege and not a right.

16. PRIVACY

Information collected through SMS programs is governed by the Super Save Privacy Policy.

Customers should also review any applicable privacy policies of third-party messaging providers.

17. TERMINATION OF PARTICIPATION

Super Save may terminate participation in SMS programs for:

  • Fraud;
  • Abuse;
  • Misuse;
  • Invalid contact information;
  • Violation of applicable policies;
  • Illegal activity.

Termination may occur without prior notice where permitted by law.

18. DISCLAIMER OF WARRANTIES

SMS services are provided “AS IS” and “AS AVAILABLE.”

Super Save makes no warranties regarding:

  • Availability;
  • Delivery;
  • Timing;
  • Accuracy;
  • Error-free operation.

19. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPER SAVE SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES;
  • INCIDENTAL DAMAGES;
  • CONSEQUENTIAL DAMAGES;
  • SPECIAL DAMAGES;
  • LOST PROFITS;
  • LOST REVENUE;
  • LOST DATA;
  • BUSINESS INTERRUPTION.

TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT PAID BY THE CUSTOMER FOR THE APPLICABLE SERVICE, WHICHEVER IS GREATER.

20. ARBITRATION AND CLASS ACTION WAIVER

All SMS-related disputes shall be governed by the arbitration and class action waiver provisions contained in the Super Save Terms & Conditions.

21. GOVERNING LAW

These SMS Terms shall be governed by the laws of the State of Illinois.

22. MODIFICATIONS

Super Save reserves the right to modify these SMS Terms at any time.

Updated versions become effective upon posting unless otherwise stated.

Continued participation in SMS programs constitutes acceptance of revised Terms.
